Terms of Service

1. Acceptance of Terms

By accessing or using TraderCongress ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TraderCongress provides a dashboard for viewing publicly available data about congressional stock trades, government contracts, lobbying activity, insider trading filings, and federal spending. Data is sourced from public APIs and government databases.

3. Not Financial Advice

THE INFORMATION PROVIDED BY TRADERCONGRESS IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. IT DOES NOT CONSTITUTE FINANCIAL, INVESTMENT, TAX, OR LEGAL ADVICE. YOU SHOULD NOT MAKE FINANCIAL DECISIONS BASED SOLELY ON THE INFORMATION PROVIDED BY THIS SERVICE.

Past performance of any investment does not guarantee future results. Always consult a qualified financial advisor before making investment decisions.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information when creating an account. You may not share your account or use another person's account.

5. Subscriptions & Billing

Paid plans are billed monthly or annually via Stripe. You can cancel at any time through the billing portal. Refunds are handled on a case-by-case basis. We reserve the right to change pricing with 30 days notice.

6. Acceptable Use

You may not: (a) scrape or bulk-download data for redistribution; (b) use the Service for automated trading without prior written consent; (c) attempt to bypass subscription limits; (d) interfere with the operation of the Service.

7. Data Accuracy

While we strive for accuracy, data may contain errors, delays, or omissions. We rely on third-party sources and public government databases and do not guarantee their accuracy or completeness. We are not liable for decisions made based on this data.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TRADERCONGRESS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ALL DATA, INFORMATION, AND CONTENT PROVIDED THROUGH THE SERVICE IS FOR INFORMATIONAL PURPOSES ONLY AND IS PROVIDED WITHOUT WARRANTY AS TO ITS ACCURACY, COMPLETENESS, OR TIMELINESS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADERCONGRESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, INVESTMENT LOSSES, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL TRADERCONGRESS'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO TRADERCONGRESS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless TraderCongress, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) any investment, trading, or financial decisions you make based on information obtained through the Service; (c) your violation of these Terms; or (d) your violation of any applicable law or regulation.

11. Dispute Resolution & Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator and shall take place in the State of Delaware, United States.

CLASS ACTION WAIVER: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST TRADERCONGRESS.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. To the extent that litigation is permissible under these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

13. Termination

We may suspend or terminate your account for violations of these terms. You may delete your account at any time from the Settings page. Upon termination, your right to use the Service ceases immediately. Sections 3, 8, 9, 10, 11, 12, and this survival clause shall survive any termination of these Terms.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
